Two Writers Accuse Dua Lipa Of Copying Their Song For ‘Levitating’

In an unfortunate turn of events,Dua Lipaand her team who penned the smash hit ‘Levitating’ were sued by two songwriters who claim the track was a rip-off of their 1979 disco single ‘Wiggle and Giggle All Night’.

L. Russell Brown and Sandy Linzer accused Dua Lipa, Sarah Hudson, and Stephen Kozmeniuk of copying and recycling their song in the singer’s 2020 album. Interestingly, Brown also had a similar case in 1980 where he claimed Miguel Bose’s ‘Don Diablo’ sounds like ‘Wiggle’. Now, he asserted Lipa’s song resembled both ‘Wiggle and Giggle All Night’ and ‘Don Diablo’.

In the suit, Brown and Linzer claimed the defendants “were inspired by past musical eras in composing the music on Future Nostalgia” (viaCBS News), and when they noticed that one of the songs in the album sounded like the disco track, Lipa and her team credited the original songwriters.

U.S. District Judge Katherine Polk Failla noted that ‘Wiggle’ and ‘Levitating’ were “strikingly similar” and “also allegedly copies a repetitive rhythm from the prior works.” The court documents presented that the allegedly copied tune occurred six times and the rhythm sixteen times.

Florida Band Claimed Dua Lipa’s ‘Levitating’ Stole Their Melody

Another lawsuit was filed after Florida-based reggae band Artikal Sound System claimed Dua Lipa’s ‘Levitating’ ripped off their 2017 song ‘Live Your Life’. For a relatively unknown band to accuse a famous pop singer of copyright infringement would seem like an unwise move, but listening closely to their song, fans would definitely hear the striking resemblance.

Unfortunately for the band, their case was dismissed in June. As perReuters, “Artikal Sound System attorney Stewart Levy said on Tuesday that the decision was disappointing and the band is considering its next steps.”

U.S. District Judge Sunshine Sykes said that the band failed to prove that the songwriters of ‘Levitating’ had access to their song, even though they claimed it was distributed through streaming services and included in several sold CD copies.
